Prenuptial Agreements in the UAE: Questions to Ask
Wedding Planning · June 13, 2025
A prenuptial agreement is a legal document, not a wedding-planning add-on. The correct drafting and authentication route, and the effect an agreement may have, can depend on the marriage, jurisdiction, nationality, assets and where it may later be used.
This page provides general questions for couples. It is not legal advice.
> Court services and the cross-border treatment of agreements can change. Each person should obtain advice for their own circumstances before signing.
Start with independent legal advice
Each person should consider separate advice from a qualified lawyer who understands the relevant UAE and cross-border circumstances. Independent advice helps each party understand the document and identify issues that a shared template may miss.
Topics for discussion may include:
- assets and debts held before marriage;
- jointly acquired property;
- business ownership and family interests;
- gifts and inheritance;
- housing and regular expenses;
- financial disclosure;
- governing law and dispute forum;
- children, noting that some matters may not be decided finally by a private agreement.
The document should reflect the couple’s facts rather than copy broad promises from an article.
Abu Dhabi publishes a civil prenup service
The Abu Dhabi Judicial Department civil marriage page currently publishes a civil prenuptial agreement service, required documents and an approved template route. It also recommends independent legal advice. Eligibility, fees, language and authentication details can change, so check the official page when applying.
Couples using another marriage route or emirate should obtain advice about the relevant court or notary process. Do not assume an Abu Dhabi form is the correct document everywhere.
Allow time for disclosure, translation and review
Raise the subject early enough for both people to review information without pressure. Ask the lawyers about financial disclosure, bilingual drafting or legal translation, signatures, witnessing, notarisation or court authentication.
If the agreement may be relied on outside the UAE, obtain advice in the other connected jurisdiction as well. No website can guarantee that one document will be treated the same way in every country.
The site’s UAE civil marriage guide and Abu Dhabi civil marriage guide cover the registration routes separately. Start with the UAE marriage registration guide if the correct authority is not yet clear. For an individual situation, speak to a qualified legal professional.
